During the second trial, on May 28, after three days of testimony, the jury was directed by Judge Shiras to return a verdict of not guilty. According to his opinion, the defense had indeed proved that a state of war existed on the reservation when Casey was killed. “The killing of Casey was a cruel act, but it was an act of war,” the judge concluded.
